Terms & Conditions
1. Scope
These Terms and Conditions govern the contractual relationship between Severin Mijatovic (Severin West) (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Buyer") for all orders made in the online shop of the Seller (www.severinwest.com).
By placing an order, the Buyer accepts these Terms and Conditions. Deviating terms of the Buyer only apply if the Seller explicitly agrees to them.
2. Conclusion of the Contract
The contract is concluded as soon as the Buyer places an order in the online shop of the Seller and the Seller confirms the order via email. A sales contract becomes legally binding when the goods are dispatched or delivered.
3. Prices and Shipping Costs
All prices are inclusive of statutory VAT. Shipping costs are not included in the price and will be shown to the Buyer during the checkout process, unless free shipping is offered.
Shipping costs depend on the destination and the weight of the ordered products and will be shown separately during the ordering process.
4. Payment Terms
The Buyer can choose from the following payment methods:
PayPal
Credit card (Visa, MasterCard)
Bank transfer
Payment is due immediately. If bank transfer is selected, the order will only be processed after the payment has been received.
5. Delivery and Delivery Times
The goods will be delivered within 6 to 15 business days after receipt of payment. If delivery is delayed due to unforeseen circumstances, the Buyer will be informed in a timely manner.
Delivery will be made to the address provided by the Buyer. We deliver worldwide, where this is possible through our production partner The Print Space. Further details on international shipping costs and delivery times can be found during the checkout process.
6. Right of Withdrawal and Return Conditions
The Buyer has the right to cancel the contract within 14 days without giving a reason. The withdrawal period begins on the day the Buyer receives the goods.
To exercise the right of withdrawal, the Buyer must inform the Seller of their decision to withdraw from the contract. The withdrawal can be sent by email to severinwest.studio@gmail.com.
Right of Withdrawal Exclusion:
The right of withdrawal does not apply to products that have been manufactured according to the Buyer's specifications or are clearly tailored to their personal needs (e.g. personalized prints or limited artworks).
7. Liability and Warranty
The Seller is only liable for damages resulting from gross negligence or intent. The Seller is not liable for damages resulting from improper handling of the delivered products.
No warranty is given for the durability of artworks, as this can vary depending on environmental conditions and care.
8. Retention of Title
The goods remain the property of the Seller until full payment is received. The Buyer is obligated to treat the goods with care until full payment has been made.
9. Data Protection
The Seller processes personal data in accordance with the Privacy Policy, which is available on this website. The data will only be used for order processing and customer support and will not be shared with third parties unless necessary for the performance of the contract (e.g. shipping providers).
10. Jurisdiction and Applicable Law
Austrian law applies. The place of jurisdiction is Vienna, if legally permissible.
11. Final Provisions
Should any provisions of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The Seller reserves the right to modify these Terms and Conditions at any time.
